Solomon Ayangkong Ikongshul, an Abuja based Human Rights lawyer, has slammed a multi-million-naira lawsuit against 9mobile for allegedly infringing on his fundamental right to privacy.
In a fundamental right action with Suit No FHC/ABJ/CS/796/2018 between Barr. Solomon Ayangkong Ikongshul v.Emerging Markets Telecommunications Service Ltd (ETMS) (Trading in the name 9mobile), the lawyer alleged inter alia that 9mobile had granted third parties or unknown persons access to his phone number without having regards to his privacy, thus seeking his consent; and the latter acting in concert with 9mobile have deliberately flooded his line with innumerous unsolicited telemarketing text messages from different codes.
Such promotional advertisements, according to him in the suit filed, are delivered at odd hours unabated monthly, weekly, daily, hourly, in some cases minutely and per seconds.
He alleged further in his affidavit that he has never subscribed to any of those messages hence unsolicited, yet 9mobile have been surcharging him for such messages despite him activating a Full Do Not Disturb service on his line and sending the STOP messages to the various codes to enable him opt out.
He therefore prays the Court to grant his reliefs and intervene in his breached and continued breach of his right to privacy.
This is coming up when private citizens have been dragging the telecom operators to court to check the abuse of their operational services.
